In my background, I have a number of different college degrees and one of them is actually is in art history and art studio so I really just feel blessed that I’ve gotten to work with a number of artists here in the Twin Cities when they have had claims. When an insurance company won’t pay for art that is damaged typically we get experts involved that can help us number one confirm the damage to the different types of art that may have been either fire, water, smoke damage, maybe damage by a change in temperature or humidity. So we get experts involved that can help us evaluate that damage and also help value the pieces of art. Sometimes art can be conserved so we can go through a conservation process and then restored.

Other times though, it’s a total loss, which is really difficult for artists because they put a lot of themselves and time into these pieces it’s really an extension of themselves. So sometimes it’s a very difficult reality to face is when this art has been destroyed. But it is something that is very specialized you certainly want to work with the right people on those types of claims because it is critical that those are handled correctly. You know we’ve seen situations kind of throughout the country where sometimes the art is restored and then it’s resold and then all of sudden it wasn’t restored properly and then there are issues with the art either disintegrating or not living up to its name, which then damages the reputation of the artist. So that’s just one example of why you really need to handle these claims carefully and fairly for the artist and make sure that everyone’s working very closely together to get the right result.

Oakdale, MN insurance coverage attorney, Adina Bergstrom, discusses what you can do if the insurance company will not pay for damaged art.
