Failure to approve medical treatment or to pay medical bills, in my opinion, is the single, most common claim that we deal with here in our office. It has become more and more common as we have progressed in our practice. Medical treatment is fundamental to the recovery of an injured worker, it’s fundamental to establishing support for later disability claims, and if that happens we aggressively file claims for approval of medical treatment so that an injured worker can get better and get back to work. And again, there are no attorney fees payable win or lose in a medical claim. If we win, and we always hope to, the insurance company pays all the attorney’s fees.
