If I Have Done Something Wrong, How can a Lawyer Help Me?

Well, by the way, I’ve tried over 20 criminal sexual conduct cases as a criminal defense lawyer, and all of the jury trials, I was fortunate enough to win, and not just because I’m a good lawyer, which I believe that I am, but because the vast majority, if not all of those cases, were false accusations, and I was able to find the evidence to prove that.

However, most of the people that have hired me to represent them on criminal sexual conduct cases, many more than that 20, at least 100, had done something wrong, and I knew they had done something wrong from the minute they came into my office, and frequently, they had already told the police that they had done something wrong. And there are a lot of things I can do for those clients and there are a lot of things that must be done for these clients in order to obtain the most appropriate disposition.

This is a complicated area, but the main thing is – and I do this with all of my clients who have done something wrong, either in this area or with federal child pornography cases – they need to be immediately subjected to a psychosexual examination. It’s a complicated series of tests done by psychologists who are trained to work in this area, and they determine exactly what is the person’s problem, how long and how deep-seated it is, and what would be the recommended course of treatment for this person.

And so the simple answer – and it’s much more complicated than this – is when somebody has done something wrong, the best way to keep them out of a very long prison sentence or to shorten their stay in the workhouse – in jail, if that’s an option – is to show the judge that they are serious and contrite and have already done something. And by the way, this is not novel in this area. It applies to all of the alcohol-related offenses. Judges like to see that the defendant has accepted the fact that he did something wrong and is trying to help himself out so that he doesn’t continue to make that mistake going – “mistake” is a poor choice of words – so he doesn’t continue to reoffend, whether it’s drunken driving or sexually assaulting children.

And so the main thing that needs to be done is to develop a trial strategy designed to get the client help, and hopefully at the same time, lessen the consequences of incarceration.
