I do anything that is a crime in state or federal court, and I have done bear-out-of-season cases, I’ve done a case involving illegal use of traps on muskrats. There’s many, many esoteric areas. I sometimes do DWIs, although I’ve got a daughter helping me with those, a lawyer in my office, my daughter, who does the misdemeanor practice, but any kind of a criminal case, I do, but besides sexual assault cases – and I’ve done numerous murder cases, and I love to be involved in murder cases, but there’s not many involved in private practice, and there hasn’t been for many years.

But besides white collar crime and sexual assault cases, my primary area of practice is defending police officers. I’ve been doing that – probably currently, 25 percent of my practice is representing police officers who either are on the job and they use deadly force and shoot somebody or they’re involved in a high-speed chase and somebody, like the suspect, or heaven forbid – and it frequently happens – an innocent bystander is killed in the high-speed chase, these are what we call “critical incidents,” and police officers are entitled to their own lawyer when a critical incident occurs, because as these cases are investigated, even when it’s clear that the use of deadly force was justified – person fired a shot, shot a couple other police officers, and then they killed him, and we have cases like that where it’s absolutely clear that the use of deadly force was justified, but the proper way to investigate those cases is the investigators sit down with the police officer and Mirandize him, and they do that for a good reason, because every taking of human life is a homicide. It’s just that some of them are justifiable: self-defense, police officers, whatever the case may – and the states that allow euthanasia, which isn’t Minnesota, those are homicides. So in every homicide, it’s investigated, and the determination must be made: is there a criminal charge that should follow?

So I’ve been representing police officers like that for many, many years.

Minneapolis criminal defense attorney Kevin Short discusses the different kinds of law he practices.
