The Golin case is ongoing and it has been in litigation for over a decade, unfortunately, involving a lot of resources from all the defendant entities including the city. In this case, the law was quite clear that if there’s probable cause to believe that someone is suffering from a psychiatric condition and is a danger to themselves that the police officer has the right under the law to take them to a psychiatric hospital for a 72-hour hold. And there was nothing that this police officer did wrong. Unfortunately, the court didn’t agree and denied the city a summary judgment motion. Because we felt the law was clear and in favor of the police officer, the city took an immediate appeal, a type of appeal called a writ, which is seldom successful but in this case, we were able to persuade the court of appeal that the trial judge made a mistake when she denied the city a summary judgment motion. As a result, the motion was granted and the city finally was moved from the case as a defendant as was the individual police officer.
