Most employment lawyers would say immediately report it to HR and that is an appropriate response. But when I counsel employees about the situation, I always want to know are you happy at work? Is this a one-time incident? Is this something where you can go to your immediate supervisor and try and work that through with them if you love your company and you want to stay? Because unfortunately, employers and people its human nature to retaliate when someone comes forward and complains. And so, I think that it’s a more nuanced approach to what is your goal? What is your goal as an employee?

Is your goal you love the company and you want to keep your job because necessarily you put your job at risk when you come forward in a complaint. If your goal is to stop the harassment and its very severe then you wanna go and you wanna report thoroughly that complaint up the chain. But I think that it’s not always as easy of a question as employment lawyers present it. You know the standard advice is report the harassment that’s not always the best solution for every single person and for every single employee. And I think that employees really need to consider all of their options before they report, although if it’s serious enough, of course, you need to report that to the employer.
