Hostile environment under Title IX is basically any sort of environment on campus whether it be overt or more subtle, which interferes with the student’s equal access to education that’s really what Title IX is about. So a hostile environment can run the gamut from sexist songs, posters, chants that we’ve heard about to more direct types of harassment based towards individuals themselves. And obviously, the ultimate form of hostile environment is sexual assault. So it’s really when you think about Title IX the law is basically designed to provide equal access to education regardless of gender and that’s the really the touchstone when evaluating anything with regards to Title IX whether it’s hostile environment, sexual assault or unequal access.
