Well, the good news is that the Supreme Court struck down the Defensive Marriage Act, otherwise known as DOMA. And what that law did was say that the federal government, even if a state recognized same-sex marriage, the federal government wasn’t going to recognize it, which means that same-sex married individuals could not file joint returns, they could not get a marital deduction when they made inter-spousal gifts. Well, the Supreme Court said that that was unconstitutional. If a state says that a marriage is valid, then it’s valid for all federal purposes as well.
