You know, it’s hard to say exactly what percentage, but I do handle a lot of sex crimes. And the trick with them is that in other kinds of cases, like a murder case, a jury sits there and they’re on the edge of their seat. They want to hear what happens, and they have more of an open mind. When you have a criminal sexual conduct case, you have – the jury is looking at your client sitting in that counsel table, in that defendant’s chair, wondering, “What did he do to get himself here?” And they almost presume that he is guilty.

And so the trick is, the jury is always going to perceive themselves as the rescuer. They want to be the rescuer. And then you have the perpetrator and the victim. And there’s a natural tendency to want to protect a child, or protect somebody that is the victim in a case. The trick is to shift the paradigm and have the jury try to rescue your client, and have the complaining witness be the perpetrator of whatever they’re trying to do. And I’ve been pretty successful at doing that.
