Generally, you do not want your estate planner to be your attorney in court for litigating the estate plan. Not only is there often a conflict of interest where the estate planner was previously representing a different party bur more importantly, it’s a different skillset. If I spent all my time drafting estate plans, I’d probably be a pretty darn good estate planner but I don’t spend most of my time drafting estate planning in fact, I draft no more estate plans. I spend my time in the courtroom and listen to clients and advocating for my clients either at mediation, at trial, at motion practice. How I spend my time as an advocate and as a counselor not as an estate planner.
