There are 50 states in this country, plus the District of Columbia. Every state has a different law and deals with the administration of deceased’s estates differently. In a state like New Jersey, which doesn’t really have a probate process, you don’t necessarily need a lawyer to help you.

In a state like Virginia, where you have to detail every penny that’s spent, every dollar, and you are not able to close an estate until every penny has been accounted for, and a creditor has given an option to file a claim over a year or two-year period of time, you absolutely do need an attorney to help you, okay? So, it depends on where you are.

Hiring an attorney to help when someone dies will probably save money, time, and taxes, in most estates. And so, I generally recommend that people hire someone to at least advise, if not do a lot of the work.
