I can’t think of a time where it doesn’t make sense to go to court and not have an attorney. Because this is what an attorney does for a living. I can’t tell you how often I see an individual in pro per, which means they’re not represented by an attorney in court and they’re struggling to figure out what they need to do and they have to go back to the court again and again and again and they just don’t understand the process. It’s a difficult process and its time consuming. And to go back and forth to court again and again and again does not benefit the individual.

Now the size of an estate determines the size of the fees, generally, in a probate. So if you have a modest estate the fees that the attorney would be entitled is significantly more modest than if you have a larger estate. So I can’t think of a time when anytime you need to go to court to get an order where it doesn’t make sense to have an attorney.
