What can employers do to try to prevent whistleblower claims specifically under the False Claims Act. Most employers do have hotlines and they’re anonymous hotlines. You can call a number. You can drop a piece of paper in a box someplace. And, those are fairly effective in allowing people to try to air the grievances internally before it becomes a problem. There are some companies that have their topline managers fill out forms to say that I’m not aware of any violations of law. No one has reported anything to me. So, to put the onus of the frontline managers, if they find out about something that’s potentially wrong or illegal within the workplace, they bubble it up – and, having a cultured atmosphere that encourages employees to bring those kinds of concerns to management, to HR, to general counsel, so that they can try to deal with those issues. It’s always best to try to deal with them internally before someone goes externally, because it may be a misunderstanding. It may be something that can be corrected internally without having to involve a government.
