An employer who decides to use a written employment agreement should be sure to include all of the material terms. The form of an employment agreement really can include an offer letter or be a more formal agreement, but you want to include the date that employment is to commence, the person’s wage rate or commission plan arrangements, whether the individual is an exempt or non-exempt employee from overtime, whether or not there are other material terms, such as a non-compete agreement and things of that nature, but really, it’s essential to just include all of the material terms of the arrangement, as well as reference whether or not the arrangement is expected to be at will.
