If you die without a will, your property will pass through what’s called intestacy, which is most states have a law that provides what will happen to your property if you don’t have a will that provides for it. The problem will the intestacy statute is one, it doesn’t always provide for the type of inheritance issues that a person may want but it also doesn’t address other issues like who’s going to administer the estate or who’s going to take custody of the children. So those issues still need to be resolved through complex litigation.
