So in a DUI the officer will many times ask the person to provide a breath test. Now that happens at two points, the first point is typically right after the stop on the roadside. This is called the portable breath test. That one is not mandatory and the officer is typically able to say this is a voluntary breath test. If you refuse that, there are no mandatory adverse consequences. Now when you go back to the station there’s a breath test machine that is mandated by law and you’ll be given advisements that if you refuse that, the penalties for this DUI increase or I should say potential penalties. We’re still able to challenge it in court, we’re still able to challenge it with the Department of Licensing but if you do refuse that, the penalties increase. Which is why I always tell somebody ask for a lawyer right away because in that situation you need to determine whether providing a breath test is in your best interest or withholding as much evidence as possible that can be used to convict you is in your best interest.
