Well one of my clients comes to me and says I’ve been arrested for a DUI and it happened, for example, last night, and they’ll ask me what do I do? There’s a couple things I suggest immediately. One, retain an attorney. Two, let’s find out where your car is a lot of individuals get arrested on a DUI and their car is either left on the side of the street or it’s been towed, let’s get the car back for you. And one of the things I also suggest is they enter into a traffic alcohol program before the arraignment date. A reason for this is many times a court itself will order you to enter into one of these programs and two, when your attorney starts negotiating with the prosecutor in this case for diversion showing that you’ve taken initiative and entered into a traffic alcohol program goes very far and it provides your attorney leverage to negotiate this for you. Finally, one thing I recommend is pull your driver license report. Get a copy of that report and provide it to your lawyer. One thing the prosecutors in the case are going to want to see is how’s your driving record? Is it clean? And a clean record goes very far. Finally, don’t talk to the police. Don’t talk to anyone about your case. The only person you should be talking to about this case is your attorney.

Washington, DC criminal defense lawyer Christopher J. Mutimer explains how to best prepare for your first DUI court date.
