It’s hard to say how a retirement is gonna be handled in a divorce. Assets and debts in New Jersey divorces are generally divided by what’s called equitable distribution, which means fair, not necessarily equal, although it normally is equal because there’s a few reasons why it shouldn’t be. But there are a lot of issues you need to consider like, one, whether or not there’s any premarital contributions or not. But also, at least for the purpose of settlement, there are tax consequences, obviously, to transfers and withdrawals of retirement accounts. And a lot of people would rather offset other assets like real estate than taking retirement accounts ’cause you can’t necessarily access them that easily.
