in family law matters in both Minnesota
00:06
and Wisconsin only about three percent
00:08
of them go all the way to a trial or
00:10
what we call an evidentiary hearing
00:11
that’s where you’ve got witnesses taking
00:13
the stand and exhibits and it’s more of
00:16
your Hollywood type trial but it only
00:19
happens at three percent of the occasion
00:21
the actual motion hearings that happen
00:23
either while your divorce is pressing or
00:25
and a lot of times after a divorce or
00:28
after a custody order comes out you have
00:30
a motion to modify child support or
00:32
parenting time or you want to change
00:34
custody any of these sort of issues this
00:37
is the bread and butter this is about
00:39
80% of our court appearances on an
00:42
annual basis are these motion hearings
00:44
and in some ways they are more important
00:46
for two reasons one because they’re just
00:49
that much more prevalent but to really
00:51
progressive law schools are going to
00:53
teach you the rules of evidence and some
00:56
trial advocacy that’s what I did back
00:58
almost two decades ago and that can
01:01
leave you with some really good trial
01:03
skills but if the majority of it is
01:05
going to be motion hearings there’s very
01:07
few programs they’ll tell you how to
01:09
craft motions put together compelling
01:11
affidavits for your client having all
01:13
sorts of attachments and really being
01:16
able to make a fierce argument at that
01:19
and without that sort of training motion
01:22
hearings are more important because in
01:24
Atticus Family Law we’ve turned around
01:26
and addressed that and we’ve got systems
01:28
in place and internal training to make
01:30
sure that all of our attorneys are ready
01:32
to give a hundred percent of our for our
01:34
clients in this time in this
01:36
circumstance when most law schools don’t
01:38
even teach that

Minneapolis, MN family law attorney Matthew Ludt explains why hearings are often more important than trials and why his firm is so well equipped to handle these for you.
