Comparative negligence varies from state to state but the idea is if two or more forces come together or two or more persons come together to cause a collision then the law is going to sort out who is at fault and how much they’re at fault taking 100 percent as the basis. For instance, in Minnesota and Wisconsin where I practice, typically speaking if a person is 50 percent at fault or less they can recover their damages minus the amount of percentage they are at fault. If they’re 51 percent at fault or more then they can’t recover anything.
