I’ve learned that city councils and county commissions and the people who make decisions for them don’t look at cases that are brought against them, like businesspeople who look at the same level of risk look at the problem. They’re much more inclined to say let the jury give us the bad news, then we can say we didn’t cave in. I’ve often wanted to buy city councils and county commissioners President Kennedy’s book, “Profiles in Courage,” so they could understand what they were doing and why they weren’t being very good stewards of the public’s money. I’ve had that discussion with a number of politicians without any good result that I can see. But rather than say this is wrong, we should just pay now – especially when the attorneys’ fees are accruing under Section 1988 of the Civil Rights Act. Rather than saying this is wrong, we need to fix it, we need to change this officer, we need to change this conduct, we need to moderate this policy, they are much more willing to just pull their neck and not face the facts, the risk, or the cost. And you can almost count on that.
