Unfortunately, the bigger the potential case the more potential money is at risk for a railroad company so all the stakes are higher. What often happens on what we call catastrophic cases: amputations, wrongful death cases, burn cases, large cases that are obvious from the very beginning that they’re going to be out of service or life threatening injuries the railroads will often pull out all the stops to make sure that an injured person and their family don’t even get a chance to talk to a lawyer on the other side. They’ll hire corporate jets to pick up family members and bring them to a hospital. They’ll bring high level company officials in to say, “Trust us, trust us, we’ll take care of you.’

And I know of many circumstances where even when a vice president or assistant vice presidents have come into the room in traumatic cases and said, “We’ll take care of you,” that the company is at the same time out gathering information to hurt that family or hurt that decedents family and it only comes out later. It cost nothing to check out both sides. If someone says, don’t check out to see if what I’m telling you is truthful whether it’s a plaintiff’s lawyer, a defense lawyer, another lawyer or the claims agent something doesn’t smell right. In order to protect you, your family be allowed to talk to both sides. And if somebody says something check it out with the other side. In fact, the best way is have the plaintiffs’ lawyer in the same room as the claim agent. I’ve done it before. I’m not afraid to talk in front of a claim agent but they don’t want to talk in front of me.
