There’s three ways, I think, to ensure that your property can pass directly to named beneficiaries and not have to utilize the probate process. First, would be to gift the assets now. The second would be to either name the beneficiary like if you have an IRA or retirement account or a bank account you can name a future beneficiary. And the last would be a trust instrument and you draft a trust that will provide similar to a will what happens to your property when you pass, except for property that’s put into a trust doesn’t have to pass through the probate process.
