The issue that causes the most problems from the date the divorce is final till the date you die is spousal maintenance, permanent spousal maintenance. First of all, permanent spousal maintenance doesn’t mean permanent it means indeterminate maintenance until something changes. And frequently that happens somebody loses a job, somebody’s expenses increase, somebody’s expenses decrease, illness can occur in one of the spouses. Retirement, of course, is an issue that comes up in permanent spousal maintenance. So my recommendation is if you can eliminate permanent spousal maintenance or limit it, you’re much better off and in that case, litigation for spousal maintenance especially in long-term marriages would be the last resort. Those cases should be solved, those cases should be settled so that there can be a clean break and both parties can to on with their separate lives without worrying about or being dependent upon the other spouse.
