Probably the most frequent thing that I tell clients is if there is a way to avoid litigation avoid litigation. Once you get into litigation you lose a lot of control and clients don’t often realize that coming in but by the same token, once they’re made that step and they’ve decided to get into a lawsuit the other most frequent advice that I probably give is if there’s a way to settle the case try to settle the case. Before you put your faith in the hands of a judge or a jury you should be able to look in the mirror and say I have done everything I can to try to resolve this case. And if you do that and you go to the judge or the jury and you get a decision that’s not favorable you can always say well, at least I did my best.
