The Texas Family Code recognizes two avenues or two procedures for getting divorced. One is a litigation method or what I’m gonna call litigation method. It is where the parties file pleadings. They will go through a discovery process. They will go through a settlement process that, if all fails, they will end up going to court. The other method is collaborative law. Collaborative law is a process that’s been in Texas since the early 2000s. It is a process whereby the participants hire attorneys, get legal advice, but have more or less said, “We’re not going to go to court.” And they will come to a settlement table and actually work together with their attorneys and with financial specialists or mental health specialists for their children, if necessary, to end up with a final divorce decree.
