In Texas, we do what is called a fair and equitable division of the community estate. The presumption is that it will be a 50/50 division of property. However, what the court will do is take into consideration how the property is titled and who has the ability to pay for that. For example, if a car is in the husband’s name more likely than not the husband will be awarded that vehicle and the debt thereon. If the house is titled in both spouses names then the court will have to make a decision on who will be awarded the house and normally one part will be awarded the debt or the mortgage on the property.
