In Texas in order for an adoption to happen, the first thing that has to happen is you have to have termination of the parental rights. Once the parental rights have been terminated then a child is free for adoption. Navigating that process can prove to be challenging at times but most of the time once we get the termination completed then we can proceed into the adoption. When there is an adoption then the court will consider number-one, what is in the child’s best interest and if being adopted is appropriate. In Texas, we have certain requirements that in addition to filing a lawsuit to have the adoption you also have to have an attorney ad litem appointed by the court to approve the adoption. The attorney ad litem represents the child or the children and there’s an adoptive home study that has to be completed. And in this community, I have several mental health professionals that I work with that are very familiar with an adoptive home study and help my client navigate that process of having an approved adoptive home study. And then once the criminal background check the attorney ad litem approves it, the adoptive home study is completed then we can have the court hearing to finalize or consummate the adoption. And those truly are very happy days when that takes place.
