What’s required is that the employee has to fill out the first page of Form I-9 and then has to produce documents that establish their identification and work authorization, and the employer records those documents on Page Two. The employer’s most important job is to look at those documents and ask themselves, “Is this document, does it appear to be genuine?” not, “Is it genuine?” just, “Does it appear to be genuine? Does it appear to relate to the person that’s giving it to me, and is it unexpired?” If all three of those questions are answered yes, then they complete the second page of Form I-9.
