The family-based immigration process starts with an application by the U.S. citizen or the permanent resident requesting the visa. If that is approved, it’ll depend on whether the family is already here in the United States, in which case they may be able to file all of the documents at once, known as the one-step process, but if the family is in another country, they have to go through the consulate process. And they are going to have to establish that legal relationship, a certified marriage certificate for a spouse, a certified birth certificate with the U.S. citizen or lawful permanent resident’s name on it for the children.
