Do you count only probate assets in someone’s gross estate? No. A gross estate includes all of the decedent’s assets, whether it’s probate or non-probate. It would include life insurance death benefits, real estate, jointly-owned assets, all retirement plans. Really anything they have control over will become a part of their gross estate.
