Well, under federal law it’s recommended that employers conduct unlawful harassment training, and actually there are some states that require it. Minnesota is not one of the states that requires it. The US Supreme Court decided a number of years ago that there is an affirmative defense for employers that actually put a program in place, that they follow on a uniform basis and that they can prove that they have taken prompt and appropriate corrective action.
I have seen that many employers tend to not conduct training because they feel that those are dollars better spent on other measures, but in my opinion, the cost of the training is a mere pittance as compared to the cost of having to defend an employment discrimination or harassment case or even the damages that could result should they lose such a case.
