An employer can never prevent itself from being sued for whistleblower or retaliation litigation but what it can do is limit its risks and control its risks. And in my experience, the way the employer does that is by having a happy workforce and employees who feel like they’ve been listened to. So for example, if an employee comes and makes a complaint to the employer, the employer should listen to that complaint and investigate it rather than ignore the complaint or move on with business as usual because that employee may become disgruntled and a former disgruntled employee.
