Can employers require a drug or alcohol test before hiring a potential employee? The answer is yes, but the employer will have to comply with the particular state law if there is a state law on drug and alcohol testing. For example, in Minnesota we have a very restrictive drug and alcohol testing statute that requires the employer to have in place a written drug and alcohol policy. This is both for employees and potentially for applicants and to make sure that they’re following the specifics of the Minnesota state law before they’re actually running that drug or alcohol screen either prior to employment or during employment.
