An individual is never told in Minnesota that you have a right to an additional test. But an additional test, if an individual asks for a blood, breath, or urine test on your own after you take the test at the request of the police officer, at least you have to be provided a telephone book and a telephone to try to arrange that at your own expense. So there’s many issues to look at in these cases, and if you refuse testing, is your refusal reasonable, and is there a physical inability to produce a test? That’s an example of some of the issues that we would look at in DUI arrests.
