You can face a vehicle forfeiture on a first-time DUI. We have a case that may go up to the court of appeals on that question. The manner in which that would happen is that hypothetically you have a child in the car and you have an over-0.2 reading or a test refusal. That has two aggravating factors in a first-time DUI, which could result in a vehicle forfeiture.

On a second-time DUI, you can face vehicle forfeiture if you have tests over 0.2, you have a child in the car, or if you refuse testing. On a third and subsequent DUI, you can face vehicle forfeiture virtually in every case.
