A debtor’s assets can be bought in bankruptcy pursuant to a section called 363, which allows somebody to purchase the assets in a bankruptcy free and clear of any and all liens and claims. It’s an incredibly important power in the bankruptcy code which allows for assets to essentially be sold, and it’s a very important power from somebody who wants and desires to purchase assets from bankruptcy ’cause it allows them to buy their assets knowing for sure that they own them and that no one could have a claim to them that can later come back.
