I think it’s because it’s human nature to look over your own mistakes or you have your own mindset of how the case was handled and you’re not looking at it through the eyes that the appellate court will see it which is based on what is presented in that box of records and transcript that they review. They don’t see the people on the stand, they don’t have those emotions, and neither does the appellate lawyer. You’re looking at exactly the same thing that the appellate court is looking at.
